Event Cancellation Insurance
The Following information relates to COVID-19 and the relevant insurance policies offered to Duck members:
The Duck for Cover Member Public Liability Insurance policy will, subject to the terms and conditions of the policy, respond to claims made against a Duck for Cover member alleging the member passed on the coronavirus while performing or teaching their approved performing activities.
For someone to be found liable of spreading the coronavirus, the claimant would need to prove that the Duck for Cover member specifically caused the illness and that the member was negligent in their actions - for example that they knew they were infected and did not self-isolate. Unknowingly passing on the coronavirus while performing or teaching would not normally meet this criterion.
If any Duck for Cover member receives a Liability claim against them alleging that they passed on the coronavirus while performing, we would recommend a claim be submitted for insurer assessment based on the specific circumstances of the alleged incident.
The Duck for Cover member Personal Accident policy will not respond to lost performing income as a result of the Coronavirus health crisis.
The Personal Accident insurance policy is restricted to cover a members lost performing/teaching income as a result of an injury suffered from an accident which occurs while performing, teaching, rehearsing (including direct transit to and from).
This policy does not cover lost income caused by sickness or medical disorders.
Duck for Cover members are encouraged to stay up to date with the Governments Response to the Coronavirus health crisis to determine the level of financial assistance they may be able to access.
The following information relates to COVID-19 and the issues currently affecting the Entertainment Industry.
Unfortunately, many Duck for Cover members will be affected by the unprecedented response by the Australian Federal and State Governments to the Coronavirus health crisis. This continues to evolve with the shutdown of most venues and the cancellation or postponement of many festivals & shows around Australia for the foreseeable future.
Unfortunately, Insurance does not exist that would cover the financial losses suffered by performers as a result of the entertainment industry being shut down in this way.
Duck members are encouraged to stay up to date with the Governments Response to the Coronavirus health crisis to determine the level of financial assistance they may be able to access.
Some Duck members may have booked venues to perform their shows and may have started advertising and selling tickets.
Many of these events planned by members will need to be cancelled or postponed.
This may leave members out of pocket in relation to expenses already incurred for venue hire, advertising, ticketing etc.
Insuring against the loss of expenses due to the cancellation of an event is a specialist Event Cancellation insurance policy that is not available as part of your Duck for Cover membership and is usually reserved for organisers of large tours and exhibitions where high value expenses are necessarily incurred upfront. This type of insurance policy also generally excludes pandemics and thus would not respond to the Coronavirus health crisis.
Any member with separate Event Cancellation Insurance who needs to cancel the event they are organising should contact their insurer to determine how the policy responds to the cancellation of the event due to current circumstances and determine the action required to submit a claim.
Any member without Event Cancellation Insurance who needs to cancel an event that they are organising should initiate commercial discussions with the venue and other suppliers to determine whether postponement of the event is a feasible option that might minimise your financial loss.
Duck members are also encouraged to stay up to date with the Governments Response to the Coronavirus health crisis to determine the level of financial assistance they may be able to access.
Some members may have planned interstate or international performances, and these trips may now need to be cancelled.
The loss of expenses incurred due to the unforeseen cancellation of a trip is usually covered under a Travel Insurance policy. Travel Insurance is not currently available as part of your Duck for Cover membership and is often arranged at the time of booking either online or through a Travel Agent.
Any member that needs to cancel a trip, and holds travel insurance for the trip, should first check if their travel provider is able to offer a refund or credit for later use. If the provider is unable to offer a full refund or credit, the member should contact their insurer to establish whether they can claim for the non-refundable expenses. Note that most travel insurance policies exclude pandemics, and thus would not cover expenses due to the coronavirus.
Any member that needs to cancel a trip, but has no Travel Insurance, should immediately contact the travel agent, airline, accommodation provider and discuss the cancellation of this trip in order to minimise your financial loss.
There are many industries similarly affected by the Coronavirus health crisis and the Australian Federal Government continues to introduce economic stimulus packages to assist everyone through the tough economic times ahead caused by Covid-19. Steadfast IRS strongly recommends that Duck for Members take this opportunity to review the Governments financial support that is available and keep up to date with changes that may offer some new form of relief.
